Terms of Service

These Terms of Service ("Terms") govern your use of the Infitnity platform, including the mobile application and website at infitnity.ai, operated by Higherpoint.com Inc. ("Infitnity", "we", "our", or "us"), a corporation registered in the United States. By accessing or using Infitnity, you agree to these Terms.

1. Who Uses Infitnity

Infitnity serves two types of users:

• Gym Owners / Administrators: Businesses that use Infitnity to manage their members, classes, and operations.
• Members: Individuals who use Infitnity to access and participate in gym activities.

2. Gym Subscriptions

Gym owners who wish to use Infitnity beyond the free trial period must subscribe to a paid plan. Subscription fees are billed monthly via Stripe. You authorize Higherpoint.com Inc. to charge your payment method on a recurring basis until you cancel. Cancellation takes effect at the end of the current billing period.

3. Payment Processing

Infitnity integrates with Stripe for payment processing. When gyms choose to collect member payments through Infitnity, they must create and maintain a Stripe Express account and agree to the Stripe Connected Account Agreement. Higherpoint.com Inc. acts as the platform and may collect a service fee on transactions processed through the platform. Stripe's terms govern all payment processing activities.

4. Acceptable Use

You agree not to:

• Use Infitnity for any unlawful purpose
• Attempt to gain unauthorized access to any part of the service
• Use the platform to process payments for prohibited goods or services
• Misrepresent your identity or business

5. Data and Privacy

Your use of Infitnity is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Gym administrators are responsible for ensuring their collection and use of member data complies with applicable laws.

6. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, fail to maintain a paid subscription after the trial period, or engage in fraudulent or abusive activity. You may cancel your account at any time by contacting us at support@infitnity.ai.

7. Limitation of Liability

To the fullest extent permitted by law, Higherpoint.com Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Infitnity. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

8. Disclaimers

Infitnity is provided "as is" without warranties of any kind. We do not guarantee uninterrupted, error-free service. We are not responsible for the actions of gym owners, administrators, or members using the platform.

9. Governing Law

These Terms are governed by the laws of the United States and the state in which Higherpoint.com Inc. is incorporated, without regard to conflict-of-law principles.

10. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes via email or in-app notification. Continued use of Infitnity after changes take effect constitutes acceptance of the updated Terms.
